Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the Tap App Jobs website, applications, and related services (collectively, the “Service”) operated by Tap App Jobs (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
2. The Service
The Service helps businesses publish job-related application experiences, configure custom forms, and receive applicant submissions by email. We store form configuration needed for the builder and apply flow; we do not retain completed applicant submission content in the Service after delivering it to your designated email recipients. We may modify, suspend, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.
3. Accounts
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or present security risk.
4. Customer content and applicants
You retain ownership of content you submit to the Service (“Customer Content”), such as job descriptions and form definitions. You grant us a non-exclusive, worldwide license to host, process, transmit, and display Customer Content solely to provide and improve the Service. Applicant submission content is delivered to you by email and is not stored by us as part of the Service after delivery; you are responsible for your use of that information and for your compliance with employment, anti-discrimination, privacy, and other laws relating to job postings and applicant data. You represent that you have obtained any rights and consents needed to collect and use applicant information in connection with your hiring process.
5. Acceptable use
You agree not to:
- Use the Service unlawfully, fraudulently, or to harm others;
- Upload malware, probe or test vulnerabilities, or interfere with the Service;
- Scrape or harvest data from the Service without permission;
- Misrepresent your identity or impersonate others;
- Use the Service to send spam or unsolicited communications in violation of law;
- Reverse engineer the Service except where applicable law prohibits this restriction.
6. Plans, trials, and billing
Paid plans, trials, and fees are described on our pricing page or in your order. Fees are billed as selected at checkout. Taxes may apply. Payments may be processed by a third party (for example, Stripe). Subscriptions renew until canceled according to the billing terms presented at purchase. You can manage or cancel subscriptions through the billing tools we provide, subject to applicable notice periods.
7. Intellectual property
The Service, including its software, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights. Feedback you provide may be used by us without obligation to you.
8. Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only in connection with the Service, except as required by law.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT APPLICATIONS OR HIRING OUTCOMES WILL BE SUCCESSFUL OR LAWFUL—THAT REMAINS YOUR RESPONSIBILITY.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT HAD PAYMENT OBLIGATIONS. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW (FOR EXAMPLE, LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR STATUTORY RIGHTS THAT CANNOT BE WAIVED).
11. Indemnity
You will defend and indemnify us and our affiliates, officers, directors, employees, and agents against third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from Customer Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights (including applicant privacy or employment claims), except to the extent caused by our willful misconduct.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we discontinue the Service. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnity, and governing law) will survive.
13. Governing law and disputes
These Terms are governed by the laws of [State/Country], excluding conflict-of-law rules. Courts located in [Venue] will have exclusive jurisdiction, except where mandatory consumer protection laws require otherwise.
